What is actually at stake here is the legitimacy of the "supreme" court. Although corrupt, there has been a modicum of consistency in their decisions - ruling against Colorado here would be a monumental mistake. Take a look at the dissenting opinions in that case and you'll see arguments so lame, that to call them "flimsy" would be aspirational.
